I'm not sure if you'd be able to use the Pro version in theme. You'd have to check with their licensing terms. I see they have a developer license, but I'm guessing that would be for including the plugin on multiple freelance projects as opposed to including in a distributed theme. If they do allow it, they may require you to embed it in the theme... you'll just have to check with them.
Besides special scenarios like this (depending on what you find out), I would always include a plugin as a separate plugin as opposed to embedding.
